THE LITIGATION PROCESS (STEP BY STEP)
This outlines the full process and where you may be right now.
STEP 1: Intake Consultation
Gathering Facts:
This step was completed during your intake consultation. We collected the key details needed to open or review your claim, including how, when, and where your injury occurred.
Claim Setup & Evidence Gathering:
After your intake, our team builds the foundation of your claim by preparing required forms (such as the DWC-1, when applicable) and requesting key documents, including identification, pay stubs, work status reports, and any insurance correspondence. This ensures your claim is properly documented from the start.
Claim Activation & Initial Filings
Formally Opening Your Claim: Once all required information and documents are collected, we officially open your claim by submitting initial applications, notifying the insurance company, and sending our Notice of Representation to establish us as your legal advocates.
STEP 2: Milestone Calls
The Welcome Call:
This call takes place once your case file is complete. We’ll contact you to schedule a brief introduction to your legal team, followed by a conversation with your Assistant Case Manager (ACM)
The Strategy Call:
Approximately a week after your welcome call, your Case Manager (CM) will schedule this call with you. This is where we review the “game plan” for your claim and answer your questions moving forward.

FREQUENTLY ASKED QUESTIONS
Clear answers to common questions about your case.
Every case is different. Some cases resolve in a few months, while others take longer depending on medical treatment, recovery time, and insurance delays. We’ll keep you informed as your case progresses and explain what may affect the timeline.
A deposition is a recorded question-and-answer session where the insurance company asks about your injury, work history, and medical treatment. Your attorney will prepare you in advance and be with you throughout the process.
No. It is illegal for an employer to fire or discriminate against you for filing a workers’ compensation claim. If you believe this has happened, notify your legal team immediately.
The value of a case depends on several factors, including the severity of the injury, medical treatment, work restrictions, and long-term impact. Your Case Manager and attorney will discuss this with you once enough information is available.
Case Status is our secure client app. It allows you to receive updates, send messages to your legal team, and stay informed about your case, all in one place.
The fastest and most secure way is through the Case Status app. This helps ensure your questions and documents are tracked and answered efficiently.
Do not ignore them. Upload the documents to Case Status or contact your legal team so they can review and advise you on how to respond.
Reimbursement requests should be submitted after approved medical appointments. Submitting them promptly helps avoid delays in payment.
Don’t panic. Contact your legal team as soon as possible. Missing forms can sometimes cause delays, but many issues can be addressed if caught early.
Missing appointments can affect your benefits and treatment. If something comes up, notify your medical provider and your legal team right away so they can guide you on next steps.
Always update your phone number, address, or email with your legal team immediately. Outdated information can delay important updates or benefits.
